CALS welcomes commission of inquiry into the urban housing crisis

CALS calls for a victim-centered commission that leads to accountability and holistic solutions following fire in Marshalltown

The Centre for Applied Legal Studies (CALS), University of the Witwatersrand, supports the Gauteng Province Premier’s announcement regarding the establishment of a Commission of Inquiry into the tragic fire in Johannesburg Central Business District (CBD). This crucial step towards addressing the root causes of the devastating incident is a significant stride toward accountability, ensuring non-recurrence, and resolving the urban housing crisis.

CALS deeply regrets the tragic loss of lives from the fire that occurred in Marshalltown, Johannesburg, on August 31, 2023. Our thoughts and prayers are with the victims' families and loved ones, who have suffered unspeakable loss as a result of the horrific fire at the Usindo shelter. We hope that the Commission of Inquiry will offer the victims and families much-needed support and healing.

We recognise the importance of this Commission of Inquiry in providing clarity and accountability for the tragic events that unfolded in the heart of Johannesburg. CALS acknowledges the immense impact that this incident has had on those affected and is committed to supporting their quest for justice and closure.

While CALS welcomes this development, we are eagerly awaiting the publication of the Terms of Reference for the proposed Commission of Inquiry. CALS hopes that the draft Terms of Reference will be open to public input, ensuring transparency and inclusivity in the inquiry process. The Terms of Reference must be victim-centered, inclusive of all affected parties, and lead to holistic solutions that address the root causes of the Gauteng urban housing crisis, within the realm of the Constitution and relevant legislation.

CALS has a long history of involvement in various commissions over the years, all with the common goal of seeking justice and promoting a more humane and equitable society. We remain dedicated to supporting the victims and their families throughout this process and believe that this Commission of Inquiry represents a significant opportunity to prevent similar tragedies from occurring in the future.

In a statement, Thandeka Kathi, Head of Programme in the Home, Land and Rural Democracy Programme at CALS, stated, "It is critical to stress that now is not the time for finger-pointing or polarisation. Instead, this is the time for cooperation, compassion, and common ground. Each of us must introspect and take action toward positive change. The victims’ needs are immediate, and we must offer them the comfort they require during this challenging time. CALS stands ready to provide any assistance and expertise necessary to ensure a comprehensive and effective inquiry."

CALS will continue to closely monitor the developments related to the Commission of Inquiry and will actively engage in advocating for a just and thorough investigation. We are committed to working collaboratively with all stakeholders to ensure that the truth is uncovered, that justice is served for the victims and their families, and that meaningful changes are implemented to resolve this multi-layered crisis.
